Counter-Notification Procedure

If you believe that material you posted on IMDH was removed or access to it was disabled by mistake or misidentification, you may file a counter-notification with our Copyright Agent.

Your counter-notification must include the following information:

  1. Your Physical or Electronic Signature: A physical or electronic signature.
  2. Identification of Removed Material: Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
  3. Good Faith Statement: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. Your Contact Information: Your name, address, telephone number, and email address.
  5. Consent to Jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if you are outside the United States, for any judicial district in which IMDH may be found), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.

Processing Time: Upon receipt of a valid counter-notification, we will forward it to the original complaining party. If we do not receive notice within 10-14 business days that the original complaining party is seeking a court order to prevent further infringement, we may replace or restore access to the removed material.

Repeat Infringer Policy

IMDH has adopted and reasonably implemented a policy of terminating, in appropriate circumstances, the accounts of users who are repeat infringers.

We will terminate the accounts of users who have been subject to multiple valid DMCA takedown notices or who have otherwise been determined to be repeat infringers.

Three-Strike Policy: Users who receive three valid DMCA notices may have their accounts terminated. We reserve the right to terminate accounts after fewer violations if we determine that the infringement is willful or egregious.

Response Timeline

We are committed to processing DMCA notices in a timely manner:

  • Initial Review: All DMCA notices are reviewed within 24-48 hours of receipt.
  • Valid Notice Response: If your notice is valid and complete, we will take action to remove or disable access to the allegedly infringing material within 2-5 business days.
  • Incomplete Notice: If your notice is incomplete, we will contact you within 2 business days to request additional information.
  • Counter-Notification: Counter-notifications are processed within 10-14 business days as required by the DMCA.
